PRIVACY POLICY FOR HOUSE OF KIDS ApS

This policy on the processing of personal data ("Privacy Policy") describes how House of Kids ApS ("House of Kids", "us", "our", "we") collects and processes information about you.

The Privacy Policy applies to personal data that you provide us with when you are in contact with House of Kids as a customer or business partner. This could be, for example, when you purchase an item from House of Kids, contact House of Kids customer service, or when you use House of Kids’ website, www.houseofkids.com (Houseofkids.com), as well as when you visit one of our physical stores or are in dialogue with House of Kids’ head office.

House of Kids ApS is the data controller for your personal data. All inquiries to House of Kids can be made via the contact information provided in section 7.

WHAT PERSONAL DATA DO WE COLLECT, FOR WHAT PURPOSE, AND THE LEGAL BASIS FOR PROCESSING

When you visit houseofkids.com, we automatically process information about you and your use of houseofkids.com. This information will typically include your activities on houseofkids.com, what you click on, what type of browser you use, what search terms you use on houseofkids.com, your IP address, including your network location, and information about your computer. Additionally, the House of Kids Cookie Policy applies when you use houseofkids.com.

The purpose is to optimize the user experience and the functionality of houseofkids.com, generate useful and accurate statistics, and based on the information we receive from you (via your use of houseofkids.com), carry out personalized marketing on houseofkids.com and via our partners if you have consented to statistical and marketing cookies. You can see which partners we use in section 3 and in our Cookie Policy.

The legal basis for the processing is your consent to our use of cookies under Article 6(1)(a) of the General Data Protection Regulation (GDPR) and our legitimate interest in improving our website and being as relevant in our marketing as possible under Article 6(1)(f) of the GDPR.
2.1.3
By accepting the use of Marketing Cookies, you consent to the use of Facebook Advanced Matching, which improves our Facebook Ads’ attribution and conversion tracking. We collect and share encrypted information with Facebook (Meta) based on your name, phone number, email, and address. Facebook then uses this information to identify your profile and subsequently create audiences of similar people. You can opt out of Marketing Cookies at any time via our Cookie Policy.
By accepting the use of Marketing Cookies, you consent to the use of Google Ads extended conversions, which improve our Google Ads’ attribution and conversion tracking. We collect and share encrypted information with Google (Alphabet Inc.) based on your name, phone number, email, and address. Google then uses this information to identify your Google profile and track your purchase. You can opt out of Marketing Cookies at any time via our Cookie Policy. Google users can also control what ads they see on Google services, including Customer Match ads, under Google’s ad settings.
2.2
When you purchase a product or communicate with us regarding our products, we collect the information you provide. This may include your name, address, email address, phone number, payment method, information about which products you buy and possibly return, inquiries and complaints, delivery preferences, and information about the IP address from which the order was made, if the order was placed on houseofkids.com.
2.2.1
The purpose is for us to deliver the products you have ordered and otherwise fulfill our agreement with you, including administering your rights to return and claim, and if necessary, contact you with relevant information about the product you purchased. We may also process information about your purchases to comply with legal requirements, including regarding product recalls and accounting. When purchasing on houseofkids.com, the IP address is collected with the purpose of safeguarding our interest in preventing fraud.
2.2.2
The legal basis for processing is Article 6(1)(b) of the GDPR and our mutual agreement to purchase from House of Kids, Article 6(1)(c) of the GDPR and our legal obligation to comply with legal requirements regarding recalls and accounting, and Article 6(1)(f) of the GDPR and our legitimate interest in preventing fraud. If you give us permission to record telephone conversations with you, the legal basis for processing these conversations will be your consent to the recording, under Article 6(1)(a) of the GDPR.
2.3
When you chat with our online customer service on houseofkids.com, we collect information about your name and the information you provide while chatting with our online customer service, as well as the advice and product recommendations you receive from us during the chat.
2.3.1
The purpose is to be able to advise you correctly about our product range in relation to the questions you ask our online customer service and to market House of Kids products in this context.
2.3.2
The legal basis for processing is your consent to participate in the chat with our online customer service under Article 9(2)(a) and Article 6(1)(a) of the GDPR.
2.4
When you participate in House of Kids Live Shopping events and make comments during the event, we collect your comments, which will be visible during the event.
2.4.1
The purpose is to market House of Kids via House of Kids’ Live and allow participants to engage in the subject and comment on the event throughout.
2.4.2
The legal basis for processing is our legitimate interest in being as relevant as possible in our marketing of House of Kids under Article 6(1)(f) of the GDPR.
2.5
When you visit House of Kids’ profiles on social media (Facebook, Instagram, LinkedIn, Google, YouTube, and TikTok), House of Kids may process the information you have made available via settings on our social media, your reactions to our posts, your sharing thereof, and comments on our posts.
2.5.1
The purpose of House of Kids’ processing of your personal data is to market House of Kids on social media, including responding to your inquiries, allowing you to participate in our contests, and contacting you if you win. When the above-mentioned social media platforms use your personal data from House of Kids’ profiles for their own use, for example, to improve their advertising system, they process your personal data as described in their privacy policies, which you can find here: Facebook/Instagram, Google/YouTube, LinkedIn, TikTok.
2.5.2
The legal basis for House of Kids’ processing is our legitimate interest in marketing House of Kids via House of Kids’ presence on the mentioned social media platforms and meeting our customers on the social media they already use, under Article 6(1)(f) of the GDPR.
2.6
When you sign up for our newsletter or otherwise give consent to receive marketing material from us, we collect and process your personal data, including your name, email address, and any preferences you have indicated. We use this information to send you relevant marketing material, including newsletters, offers, and promotions, via our email marketing platform, Klaviyo. We process your personal data to optimize our marketing and conduct profiling, enabling us to better target marketing materials to you and your interests.
2.6.1
Purpose: The processing is carried out to deliver personalized and relevant marketing materials to you based on your interests and previous interactions with our website.
2.6.2
Legal basis: The processing of your personal data is based on your consent, in accordance with Article 6(1)(a) of the General Data Protection Regulation. You can withdraw your consent at any time by unsubscribing from the newsletter via the link at the bottom of each email.
2.7
If you enter into a commercial relationship with us, either as a private individual or as an employee of a company we collaborate with, we process information about your name, email, phone number, company or private address, and any other information you provide to us in connection with our relationship and your inquiries.
2.7.1
The purpose of House of Kids' processing is to manage our business relationship with you and the company you represent and to fulfill House of Kids' obligations in this regard.
2.7.2
The legal basis for this processing is normally the contractual relationship that is established or being established between you and/or the company you represent and House of Kids, in accordance with Article 6(1)(b) of the General Data Protection Regulation. Depending on the nature of the cooperation, the legal basis may also be House of Kids' legitimate interest in establishing and managing the relationship between you and/or the company you represent, in accordance with Article 6(1)(f) of the General Data Protection Regulation.
3.
RECIPIENTS OF PERSONAL DATA
3.1
When you use houseofkids.com, as mentioned in section 2.1, we load content from third-party websites as part of the user experience. This happens, for example, by loading our score on Trustpilot. When the content is loaded, HTTP(S) communication takes place directly between your device and the current company’s servers. The HTTP protocol is the standard through which web services communicate, and it involves your browser sending data about your visit to houseofkids.com, as well as information about your browser, your operating system, the URL you are visiting, and your IP address. In these cases, as a user, you will be subject to the privacy policy of the relevant company, and we refer in this context to Trustpilot's privacy policy (here).
If you have consented to statistics and marketing cookies, House of Kids uses third-party technologies, some of which are located outside the EU/EEA. These technologies are used to collect data for the purpose of statistics, analysis, and marketing on House of Kids’ channels and for optimizing our advertisements outside of houseofkids.com. This means that if you consent to statistics and marketing cookies when visiting houseofkids.com, our partners will receive certain information about you and your use of houseofkids.com. In section 3.7, you can see which partners outside the EU/EEA we use, the purpose of our use, and what information we share with them about your use of houseofkids.com. When our partners use personal data collected on houseofkids.com to improve their advertising system, they are independent data controllers and process your personal data as described in their privacy policies. 3.2
In connection with the delivery of goods you have purchased from House of Kids, information about your name, address, email, phone number, order number, and specific delivery requests will be shared with the carrier responsible for delivering the purchased goods to you. For non-stock items, the mentioned information may be shared with the manufacturer or seller of the item in question, who will then be responsible for the delivery. Additionally, your information may be shared with business partners who assist with our business activities, including lenders and municipalities in the case of goods granted by the municipality.
3.3
When you complete payment transactions on houseofkids.com, this is done via House of Kids' PCI (Payment Card Industry - Data Security Standard) certified partner, Altapay. The information is stored in a secure PCI-certified environment that complies with international security standards. When you use a payment card on houseofkids.com, only House of Kids' PCI-certified partner Altapay — not House of Kids — has access to your information.
3.4
Information that House of Kids processes about you in connection with a business relationship will not be shared with third parties unless necessary for the purpose of the relationship, or it is necessary for us to safeguard a legitimate interest, such as in the case of disputes, where information may be shared with advisors, authorities, and legal entities.
3.5
Information may be passed on to external partners who process the data on our behalf as our data processors or on their own behalf based on joint data responsibility agreements. We use external partners for, among other things, technical operation of systems, improvements to houseofkids.com, statistics, analysis, targeted marketing, and for your evaluation of our company and products. We have entered into written data processing agreements with all data processors and joint data controllers who process personal data on our behalf or jointly with us.
3.6
To the extent that we use partners established outside the EU/EEA, this will always be done in compliance with valid transfer guarantees in the form of the EU Commission’s standard contractual clauses under Article 46 of the General Data Protection Regulation or for companies established in the USA based on their participation in the EU-U.S. Data Privacy Framework program (DPF). To ensure transparency in the processing of your information, we, as the data controller, must inform you of your rights.

The right of access
4.2.1
You are entitled at any time to request information about, among other things, which information we have registered about you, the purpose of the registration, what categories of personal data and recipients of information there may be, and information about the source of the information.

You have the right to receive a copy of the personal data we process about you. If you would like a copy of your personal data, you must submit a written request to mail@houseofkids.dk. You will be asked to provide proof of your identity.
4.3
The right to rectification
4.3.1
You have the right to have inaccurate personal data about yourself rectified by us. If you become aware of errors in the information we have registered about you, you are encouraged to contact mail@houseofkids.dk so that the information can be corrected. You will be asked to provide proof of your identity.
4.4
The right to erasure
4.4.1
In certain cases, you have the right to have all or some of your personal data deleted by us, such as if you withdraw your consent and we do not have another legal basis for continuing the processing. To the extent that further processing of your information is necessary, for example, for us to comply with our legal obligations or for legal claims to be established, asserted, or defended, we are not required to delete your personal data. If you contact mail@houseofkids.dk requesting deletion, you will be asked to provide proof of your identity.

The right to restrict processing to storage

In certain cases, you have the right to have the processing of your personal data restricted to storage only, for example, if you believe that the information we process about you is inaccurate. You must contact mail@houseofkids.dk if you wish to exercise this right. You will be asked to provide proof of your identity.

The right to data portability
4.6.1
In certain cases, you have the right to receive personal data that you have provided to us in a structured, commonly used, and machine-readable format and have the right to transfer this data to another data controller. You must contact mail@houseofkids.dk if you wish to exercise this right. You will be asked to provide proof of your identity.
4.7
The right to object
4.7.1
You have the right at any time to object to our otherwise lawful processing of your personal data, including direct marketing and the profiling carried out to target our direct marketing. If you do not want us to use your personal data for direct marketing and profiling, you must also delete your cookies, as mentioned in section 5.1 below. You must contact mail@houseofkids.dk if you wish to exercise this right. You will be asked to provide proof of your identity.
4.8
The right to withdraw consent
4.8.1
You have the right at any time to withdraw any consent you have given us to a specific processing of personal data, including to chat with an online customer service representative, to receive marketing from My House, or to cookies. If you wish to withdraw your consent, you must contact mail@houseofkids.dk. You will be asked to provide proof of your identity. Cookie consents can be withdrawn by clicking on the 'cookie' icon in the bottom left corner on houseofkids.com.
4.8.2
If you choose to withdraw your consent, it does not affect the legality of our processing of your personal data based on your previous consent prior to the withdrawal. If you withdraw your consent, it will only take effect from that point onwards.
4.9
The right to lodge a complaint
4.9.1
You have the right at any time to lodge a complaint with the Data Protection Authority regarding our processing of your personal data. Complaints can be submitted via email to dt@datatilsynet.dk or by phone at +45 33 19 32 00.
5.
DELETION OF PERSONAL DATA
5.1
Data collected about your use of houseofkids.com in accordance with section 2.1 will be deleted according to the rules in House of Kids’ Cookie Policy. The individual expiry periods are listed in House of Kids' Cookie Policy, where you can also read more about how you can delete your cookies whenever you wish.
5.2
Data collected in connection with your purchases and inquiries to House of Kids in relation to this, as mentioned in section 2.2, will typically be deleted a little over 2 years after your purchase, once the right to complain about the product has expired. However, data may be retained for a longer period if we have a legitimate need for extended storage, for example, if it is necessary for legal claims to be established, asserted, or defended, or if storage is necessary to comply with legal requirements. Data on the return of goods will be stored for 5 years after the end of the year in which the return was made, in accordance with invoice requirements and accounting legislation.
5.3
Data about your use of online chat with our online customer service representative in accordance with section 2.3 will be deleted after 60 days.
5.4
Comments and questions you provide during House of Kids Live Shopping events on houseofkids.com, as mentioned in section 2.4, will remain on houseofkids.com for as long as the relevant House of Kids Live Shopping event has business value for House of Kids.
5.5
Data collected about you as a MyHouse member in accordance with section 2.5 will be deleted 30 days after you opt out of MyHouse, in accordance with the processing of MyHouse personal data.
5.6
Data you provide on House of Kids’ social media profiles in accordance with section 2.7 will generally remain on these profiles as part of the site's history unless you delete them yourself. Data that House of Kids processes about you as a result of your participation in competitions, and which are subsequently copied into House of Kids' systems, will be deleted after 3 months.
5.7
Data originating from a business relationship as mentioned in section 2.8 will be retained as long as they are relevant in relation to the existing or potential business relationship and for a subsequent period, as long as it is necessary for House of Kids to document the relationship.
6.
SECURITY
6.1
We have implemented appropriate technical and organizational security measures to prevent personal data from being accidentally or unlawfully destroyed, lost, altered, or impaired and to prevent unauthorized access or misuse.
6.2
Only employees who have a genuine need to access your personal data in order to perform their work will have access to the data. These employees are instructed on how personal data should be handled securely.
